Drunk Driving Caused 6177 Accidents|

Congress stiffened the penalties imposed on those who drive public service vehicles while intoxicated or narcotics. Thus, ordered reduced to 0.25 grams – liters tolerance blood alcohol for drivers of these transport units.
The approved proposal states that the custodial sentence for driving while intoxicated will be between one and three years or community service from 70 to 140 days, or disqualification if the officer serving the public transport of passengers, goods or cargo in general, shows traces of alcohol in greater proportion than 0.25 grams, liters.
In the event that a driver of a motor vehicle is found no presence of alcohol greater than 0.5 grams, liters or under the influence of drugs shall be punished with deprivation of liberty of not less than six months or more than two years.
The conviction will be not less than one year nor more than four if the offense is not observed the rules of profession, occupation or industry, and not less than one year nor more than six when they are more victims.
The benefit of reduction of sentence shall not apply to young people between 18 and 21 years of age if they incur recidivism.
In 2008 there were 6.177 accidents, which caused the death of 891 people and injuries to 5,200. With regard to 2007, the number of accidents increased by 13%.
The third cause of death among Peruvians by traffic accidents caused by drunk driving.
It was published in El Peruano Law 29439, which amends the Criminal Code and Criminal Procedure Code, establishing drastic sanctions for drivers driving vehicles while intoxicated or under the influence of toxic and cause injury or homicide culpable.
Among others, the new rules effective from November 20, 2009 are as follows:
Responsibility restricted: age 18 and under 21 years of age or adults over age 65, repeatedly (more than 1 time) committed the crimes of homicide and injuries inflicted (by traffic accidents, for example) no longer be entitled to reduce the punishment for the crime because of their age.

Manslaughter: Drivers who commit manslaughter while under the influence of drugs, narcotics or presence of alcohol in blood ratio greater than 0.5 grams – liter (including transportation) or greater than 0.25 grams – liter (public passenger transport / load) shall be punished by imprisonment of not less than 4 nor more than 8 years and disqualification for a period equal to drive
Injuries inflicted: The driver that causes serious injuries inflicted while in the presence of drugs or alcohol in blood: 0.5 grams – liter (including transportation) or greater than 0.25 grams – liter (public passenger / cargo) will be punished with imprisonment for not less of 4 or more than 6 years.
Drunk driver: The drunk driving a vehicle (0.5 grams – l) shall be punished with imprisonment of not less than 6 months nor more than 2 years (the previous sentence was not more than 1 year).
To the driver of public transport of passengers or goods (0.25 grams – liter), the dui penalty is not less than 1 nor more than 3 years (the previous penalty was no more than 2 years).
Resistance to authority: The driver of the vehicle operated by the authority, which refuses to pass the doping ethyl, shall be punishable with not less than 6 months or more than 4 years (the previous penalty was no more than 2 years).
Escape to the driver: The driver after an accident on the run will be punished by not less than 6 months or more than 4 years (the previous sentence was not more than 3 years)

Validity of the Law 29 439: New penalties for traffic offenses and procedural rules will take effect the day after its publication, that is, from Friday November 20, 2009.
